This commentary is a snapshot of the current state of intellectual property enforcement in China in light of a controversial new treaty aimed at tackling the illegal but thriving industry, according to all reports, of trade in stolen and counterfeit goods. Starting with an overview of IP-intensive sectors, this commentary highlights the importance and value of this unique form of ownership, both for individuals and for national economies. This commentary then turns to the areas of trade most affected by counterfeiting and piracy, and discusses China`s predominant role in the epidemic and its imitator subculture, known as “Shanzhai”. Then, a discussion on the evolution of IP rights in China will be presented, combined with a general historical exhibition, to give an overview of the ideologies that influence China`s current attitude towards IP. In this context, this commentary discusses ACTA and examines its relevance in light of similar contracts that preceded it and China`s strange absence from ACTA negotiations and drafts. In return, this comment indicates that even if China were to become a signatory to the treaty, the theft of intellectual property in China will likely continue as usual, given that history indicates that positive changes in the enforcement of IP rights in China will occur through domestic means and not through the imposition of a strict treaty by China`s more developed neighbors. Finally, this commentary discusses such an internal change, a new Chinese infringement law, which is expected to have a positive and widespread impact on intellectual property protection in China.
